WAKESURF CONROE LLC — MEMBER ACTIVITY WAIVER, RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT

PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY. BY CREATING AN ACCOUNT YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.

1. PARTIES
This Agreement is between Wakesurf Conroe LLC ("Company") and the person creating a member account ("Member"). It governs all use of the Company's boats, equipment, coaching, sessions, and programs on Lake Conroe and any other water body ("Club Activities").

2. ASSUMPTION OF RISK
Wakesurfing, wakeboarding, and related water sports are inherently dangerous and carry a risk of serious injury or death. By participating, you voluntarily assume all risks, including but not limited to: falls and collisions with the boat, rope, or wake; drowning or near-drowning; hypothermia; spinal cord injury, traumatic brain injury, and broken bones; cuts and lacerations; injuries from boat propellers, ballast systems, or mechanical failure; injuries caused by other participants; delays in emergency response due to remote lake location; and heat-related illness.

3. EXPRESS RELEASE OF LIABILITY AND WAIVER OF NEGLIGENCE
IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN CLUB ACTIVITIES, YOU — ON BEHALF OF YOURSELF AND YOUR HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS — HEREBY EXPRESSLY AND IRREVOCABLY RELEASE, WAIVE, AND DISCHARGE WAKESURF CONROE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, COACHES, VOLUNTEERS, BOAT OWNERS, AND AGENTS ("RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, OR DAMAGES ARISING OUT OF YOUR PARTICIPATION IN CLUB ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE — WHETHER ACTIVE, PASSIVE, OR CONCURRENT — OF THE RELEASED PARTIES. YOU EXPRESSLY ACKNOWLEDGE THIS WAIVER COVERS THE RELEASED PARTIES' OWN NEGLIGENCE, AS REQUIRED UNDER TEXAS LAW.

4. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, losses, costs, expenses (including reasonable attorney's fees), and damages brought by you or any third party arising from your participation in Club Activities, your breach of this Agreement, or your violation of any law or club rule.

5. PARTICIPANT REPRESENTATIONS
You represent and warrant that: (a) you are in good physical health and know of no medical condition that makes participation dangerous; (b) you are a competent swimmer or will wear a Coast Guard-approved life jacket at all times on or near the water; (c) you are not under the influence of alcohol, drugs, or any medication that impairs judgment or coordination; (d) you have disclosed any physical limitations or medical conditions to club staff before participating; (e) you are 18 years of age or older, or this Agreement is signed by your parent or legal guardian; and (f) all persons in sessions you book or host are active Wakesurf Conroe members or valid guests within the club's guest policy.

6. EQUIPMENT AND BOAT DAMAGE
You agree to use all club equipment, boats, and facilities responsibly. You are personally responsible for the cost of repair or replacement of any property damaged by your misuse, negligence, or intentional misconduct, or that of guests you bring.

7. EMERGENCY MEDICAL AUTHORIZATION
If you are incapacitated and unable to consent, you authorize the Released Parties to seek emergency medical treatment on your behalf. You agree to be responsible for all costs of such treatment. The Released Parties are not liable for medical decisions made in good faith during an emergency.

8. PHOTO AND VIDEO RELEASE
You grant Wakesurf Conroe LLC a non-exclusive, royalty-free, perpetual license to use photographs and videos in which you appear, taken during Club Activities, for promotional and marketing purposes. If you do not consent, you must notify us in writing at info@wakesurfconroe.com before your first session.

9. SAFETY RULES
You agree to follow all safety rules, club policies, and coach instructions at all times. The captain or coach on the water has final authority over session safety. Violations may result in immediate removal from the water and termination of membership without refund.

10. MINORS
If enrolling a minor under 18, a parent or legal guardian must sign a separate Minor Participant Addendum before the minor's first session. Electronic acceptance of this waiver does not substitute for a signed paper Minor Addendum.

11. HEALTH AND COMMUNICABLE ILLNESS
You agree not to participate in Club Activities while experiencing symptoms of any communicable illness, including fever, respiratory, or gastrointestinal symptoms.

12. SEVERABILITY
If any provision of this Agreement is found unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect.

13. GOVERNING LAW
This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in the state or federal courts of Montgomery County, Texas, and you consent to personal jurisdiction there.

14. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between you and Wakesurf Conroe LLC regarding assumption of risk and release of liability, and supersedes all prior representations on these subjects.

15. VOLUNTARY EXECUTION
By creating a Wakesurf Conroe member account, you confirm that: (a) you have read this Agreement in full; (b) you understand its terms and legal consequences; (c) you have had the opportunity to seek independent legal advice; and (d) you are signing voluntarily and not under duress. This Agreement is binding on you, your heirs, executors, administrators, and assigns.
